These Terms and Conditions (“Terms”) govern your access to and use of Sofayo (the “Service”), provided by Sofayo (“we,” “us,” or “our”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. The Service
Sofayo is a software-as-a-service booking platform for salons and similar businesses. Features include booking management, employee and customer profiles, commissions, leave tracking, and revenue reporting. We may add, change, or remove features over time.
2. Eligibility & Accounts
You must be at least 18 years old and able to enter into a binding contract to use the Service. You are responsible for the accuracy of your account information, for keeping your credentials secure, and for all activity that occurs under your account.
3. Subscriptions & Billing
- Sofayo is a paid subscription from the day you sign up. There is no free trial.
- Subscription fees are billed in advance and renew automatically until you cancel.
- You can cancel anytime from your dashboard. After cancellation you keep access until the end of your current paid period; you will not be charged again.
- All payments are non-refundable. See our Refund Policy for details.
- We may change prices with at least 30 days’ notice. Price changes apply to the next billing period.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful, fraudulent, or harmful purpose.
- Upload content that infringes intellectual property or privacy rights.
- Attempt to reverse engineer, scrape, or interfere with the operation of the Service.
- Use the Service to send spam or unsolicited communications.
- Share your account credentials with anyone outside your business.
5. Your Data
You retain all rights to the data you submit to the Service (e.g., salon information, services, employees, customers, bookings). You grant us a limited licence to host, process, and display your data solely to operate the Service. You are responsible for the lawfulness of the data you upload, including any consents required from your customers.
You may export your data from your dashboard. After cancellation, your data remains exportable for 30 days, after which it may be permanently deleted.
6. Intellectual Property
The Service, including its software, design, and branding, is owned by Sofayo and protected by intellectual property laws. We grant you a non-exclusive, non-transferable, revocable licence to use the Service in accordance with these Terms.
7. Third-Party Services
The Service may rely on third-party providers (e.g., payment processors, email delivery, hosting). We are not responsible for the acts or omissions of those providers beyond what we directly control.
8. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure against every possible threat.
9. Limitation of Liability
To the maximum extent permitted by law, Sofayo will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill. Our total liability for any claim arising from or related to the Service is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim.
10. Indemnification
You agree to indemnify and hold Sofayo harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your data, or your breach of these Terms.
11. Termination
You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your account if you violate these Terms, fail to pay, or use the Service in a way that risks harm to us, other users, or third parties. On termination, your right to use the Service ends immediately.
12. Changes to These Terms
We may update these Terms from time to time. Material changes will be announced via the Service or by email. Continued use after the changes take effect means you accept the updated Terms.
13. Governing Law
These Terms are governed by the laws of the jurisdiction in which Sofayo is established, without regard to conflict-of-law principles. Disputes will be resolved in the courts of that jurisdiction, unless mandatory consumer protection laws apply.
